1) December 1976, in Mesa County, held in the Grand Junction City Courthouse, with Judge William Ela presiding.

Following the first trial, an appeal was filed to the Colorado Supreme Court. by Colorado State Public Defenders, Carol L. Gerstl and Norman L. Mueller on behalf of the Defendant, Kenneth H. Botham, Jr.

The Colorado Supreme Court's Decision in response to the Appellant Brief.  The Supreme Court reversed the defendant's convictions and the cause was remanded to the district court for a new trial before a different judge at a new location.
