A hearing on a motion for discovery of evidence in the Kenneth H. Botham murder case was called off this morning by Dist. Judge William Ela.

The judge stayed proceedings in the hearing late Tuesday afternoon, based on a motion filed by the public defender Monday.

In that motion, the public defender noted that the defendant intends to seek a reversal of the ruling denying change of venue through an original proceeding before the Supreme Court.

Public Defender Robert Emerson said this morning the proceedings will not go to the Supreme Court until a transcript of the May 4 and 5 change of venue hearing has been prepared by a Mesa County District Court reporter.  He estimated that would take at least two weeks.

Meanwhile, further pretrial hearings will not be held.

Botham is charged with the murders last Aug. 23 of his wife and her neighbors, Mrs. Linda Miracle and sons, Troy and Chad.
